I’ve been divorced for a few years, and now I live with my boyfriend. He’s very generous and takes me on a couple vacations each year. My ex-husband seems to be frustrated by this and just filed a motion to decrease his child support. Can he do that?

Dear Stacy,
Either party can move to modify child support post-judgment if there is a substantial change of circumstances. However, if your boyfriend is simply paying for you to vacation, that does not effect child support. If your ex-husband was paying you alimony, and he could prove that your live-in boyfriend was contributing to household expenses, then that would be a reason to modify alimony, but not child support. You should consider consulting with an attorney and see if you can file a Motion to Dismiss based on a lack of a substantial change in circumstances.
