Dear Attorneys,

My lawyer told me to only text with my spouse “like it will one day be read aloud in court” while we are going through our divorce. Why did she say that? I don’t even know what that means!

Dear Tisha,

Text like it will one day be read aloud in court” is a common saying amongst family law attorneys. The point of the statement is that if you put it out there into the universe, you should be prepared for the entire universe to hear it. Most people have sent a text message or email that they live to regret, but you definitely do not want it to be something that can affect your divorce. When you are communicating with your spouse (during and after the divorce), always have in the back of your mind that the communication may be used as evidence one day. There is also a saying that a “non-human” witness is the best kind, and it’s because a document, such as a screenshot of a text, a photograph, a call log, etc., cannot lie, and it cannot crack under the pressure of a cross-examination. In the alternative, a witness can testify that he did not do something, but if there is a screenshot of a text message wherein, he tells his friend about the incident in question, that would be a lot harder to refute!
