Dear Attorneys,

I want to get divorced quickly.  I figured I could get an attorney to draft everything up, but it would be better if my spouse didn’t hire anyone. That would keep it less messy, right? We also want to save as much money as possible.

That sounds great in theory, but it may actually be better if your spouse retains counsel. Generally, when each party has his or her own attorney, it makes things easier because the attorneys can communicate and cantry to settle issues outside of court.  It also takes away from the emotions of the parties dealing with each other directly, or a self-represented party dealing with an attorney.  However, during the COVID-19 health crisis, it seems as though matters with attorneys are moving more quickly than even under normal circumstances. Since Connecticut courts are only having priority one family matters come into court in person, many standard issues that arise at the beginning of a divorce cannot be addressed right now, absent an agreement. When both parties have an attorney, the attorneys know how to work together, when appropriate, to reach temporary agreements that can be electronically filed with the court.

If you want a “quick” divorce, you and your spouse will both have to agree to waive the 90 day waiting period, which used to be mandatory. You will also need to reach a full agreement in order to finalize your divorce.

Then, because divorce agreements are being entered without a court appearance currently, you will both need to notarize several documents, and sign the agreement to be uploaded electronically. If only one of you has an attorney, that attorney may only upload documents on one party’s behalf. Your spouse would need to find a way to do that on their own. Pro-se parties often encounter difficulties when it comes to signing up for the electronic filing system, so they end up mailing documents to the court instead.
