Spring is here, and you know what that means-it’s the most popular time of year to buy (or sell!) your house! The warmer weather brings out those “For Sale” signs, and buyers are eager to grab those houses while they are still on the market.

Our office has handled countless closings, and while you may not feel as though you need an attorney to represent you in buying or selling a home, it is actually required in the State of Connecticut if you are purchasing a home.

Yes, banks can offer you an attorney to assist in the closing process, but that attorney may not represent you. You must read the fine print. Often, they are actually advocating for the bank (lender) and thus, the buyer is often left without an advocate on your side.  When selecting your lending bank, make sure to check if they require a buyer’s attorney to be on their approved attorney list. Once you know that, you can decide who you should hire to represent you.  The banks may not alert you to those sneaky hidden fees that lenders so often include in your contracts, and may not tell you up front that if you hire your own attorney who is not on their list, there is an additional fee.

If you’re selling your own home and don’t have your own attorney, the lender’s attorney may not let you know as the seller that there are certain buyer’s credits. Those leave you with less profit when your house if officially sold.
