Dear Attorneys,

I feel like my divorce is just dragging on unnecessarily. I don’t actually think it’s my lawyer holding up the process. However, opposing counsel always misses deadlines, and we’ve had court re-scheduled a couple times. Is there anything that I can do to move it along more quickly?

Dear Raymond,

It’s always frustrating when things are not moving as quickly as you would like. If opposing counsel is actually delaying your case, you may have an option of filing a motion for sanctions against him or her. You may want to discuss this with your attorney, but keep in mind that it is not always an appropriate option. As far as the court dates being rescheduled, you should speak with your attorney regarding why the dates have been re-scheduled. If it is just that the court rescheduled it, there really may not be any recourse. However, there could still be an option to file a case flow request to help move it along. Again, if it goes back to opposing counsel, and especially if it seems like it is an intentional delay, you may want to move forward with sanctions.
