Dear Attorneys,
I was just served with divorce papers, but I really wanted to do mediation instead. Is that no longer an option? If this could remain as amicable as possible, I’d be much happier.
Sincerely,
Served First
Dear Served,
You are in luck! You can absolutely decide to use a mediator even though your divorce has already been started. That said, your spouse will need to be on board with this. If your spouse already has an attorney, that is also fine, as you are each entitled to your own independent counsel to review whatever the mediator drafts for you.
You may even be in a better spot now that your divorce has already been started, because should you find yourself in a situation where you need to file a motion or other document with the court, you will have that ability right away.
