You read that correctly, 6 out of 10 adults in America do NOT have a Last Will and Testament. This may seem like quite the exaggeration, but we assure you it is not. It’s very common for people to put off drafting their estate plan because they can be seen as morbid.

While no one wants to think about the worst case scenario, it is necessary to create a cohesive estate plan. This will ultimately protect your assets and your loved ones when the time comes.

Sometimes people avoid drafting their estate plan documents because they worry about changes in the future. Maybe you will want to leave items to your grandchildren, but they aren’t born yet. Maybe you are contemplating divorce and would want your future spouse to be beneficiary. Those are all perfectly understandable goals, but you should know that estate plans can be easily updated with any changes you’d like to make over time.

Protecting your assets is a top priority, especially if you would like your family members to inherit them. We encourage our clients to check their beneficiary information. Your beneficiaries on your accounts should match up with the beneficiaries to those same accounts in your estate plan. That consistency will be helpful when it comes to probating your estate. If the beneficiaries do not match, the discrepancy can hold things up in probate court.
