Dear Attorneys,

My ex-girlfriend announced she was pregnant about a week after we broke up. I’m fairly positive that the baby is mine. I’ve tried to reach out a few times now, but she just keeps ignoring me. If the baby is mine, I want to be a part of his life. How do I get to have parenting time with him?

Dear Potentially,

Congratulations! (potentially). Ultimately, you cannot have parenting time until you determine paternity. If your ex-girlfriend will not cooperate with a paternity acknowledgement or paternity test, then you will need to file a petition in probate court. After you have a hearing, so long as you can prove by clear and convincing evidence that you are likely the father of the child, the Court will issue an Order for a paternity test to be done. So long as the test indicates that you are the father, there will then be an acknowledgement of paternity. Once you have that, you can file a custody application to request visitation in Superior Court. It is sometimes a lengthy process, but it is worth it to be a part of your child’s life.
