Dear Attorneys,

I recently filed for divorce and we just had our first court date. I reviewed my husband’s financial affidavit, and he has cryptocurrency that I didn’t know about. Am I entitled to a portion of that in the final agreement?

Dear Cathy,

If your husband obtained his cryptocurrency during your marriage, then yes, you are likely entitled to a portion of it. It sounds like your divorce is fairly new, so you may not have exchanged financial discovery yet. When you do, the crypto statements should be disclosed to you. If they are not, you should ask your attorney to pursue them. Cryptocurrency tends to be more volatile than other investments, and is still somewhat of a “niche” market. If there is a substantial amount of cryptocurrency, then you may want to consult with a financial advisor who has experience in dealing with such. While it can be divided easily if you have your own crypto wallet, not all cryptocurrency is the same, and you want to ensure that you are getting a fair share of it. Additionally, if you do not want cryptocurrency, the value of such may be used to offset another asset through the divorce. You should consider contacting your attorney and ask what the best next steps would be.
