Dear Attorneys,

I own my own business, so I am on my husband’s health insurance (as are my children). I recently filed for divorce, but I want to stay on my husband’s insurance. Is that possible?

Dear Isla,

The short answer is, no. You can only remain on your spouse’s insurance plan for thirty (30) days past the date of dissolution. If you have a “young” case, as in, it has not been pending long, you may be able to wait to finalize your divorce for a bit to get yourself set up with insurance, but no, you cannot remain on your husband’s. That said, your children certainly can. We are lucky in Connecticut to have various state-run health insurance programs, so it is likely that you would qualify for one. If you have questions, you should reach out to an individual health insurance agent and/or your attorney.
